INFORMATION ON PROCESSING OF PERSONAL DATA
Written information pursuant to and for the purposes of Article 13, Legislative Decree dated June 30th, 2003, no. 196.
In compliance with the provisions of Legislative Decree dated June 30th, 2003, no. 196, the information regarding the purposes and methods of processing of personal data and the scope of communication and diffusion, the nature of the data in our possession and their communication to third parties, are hereby presented.
SCOPE AND OBJECTIVES
The processing of personal data is performed by Sfera Labs Srl solely for operations required for the management of the economic and contractual relationship and for the purpose of fulfilment of tax and accounting obligations prescribed by national and EC legislation; in order to make proposals and offers of economic nature, entertain business correspondence as well as for data storage.
USE OF COMPUTER SYSTEMS – MANUAL PROCESSING
Processing of personal data will be carried out manually or with the aid of computer systems, exclusively by authorised personnel or organisations. Such processing of data includes any operation provided for in Article 4, paragraph 1, letter A, of the Legislative Decree no. 196/2003 and required by the aforementioned Objectives
COMMUNICATION OF PERSONAL DATA
The data being processed are made available to:
• Accounting and tax consultants for the fulfilment of the accounting and tax obligations established by national and EC legislation;
• Other parties when required by law.
Any further communication and diffusion will be subject to explicit consent.
PERSONAL DATA PROCESSING AND THEIR COMMUNICATION
The nature of the personal data treated is not sensitive. The communications of data is required as necessary for the fulfilment of the obligations deriving from the contract and the accounting and tax regulations.
Sfera Labs Srl notifies that any non-communication or miscommunication of such data, may result in the following consequences:
• Blueup Srls inability to ensure the respect the provisions of the contractual agreements to which the data are referred to;
• potential non compliance of the results of data processing to the requirements imposed by the tax and accounting regulations.
A data subject will be able to assert their rights as expressed in articles 7, 8, 9 and 10 of Legislative Decree dated 30 June 2003 no. 196 by contacting Blueup Srls at firstname.lastname@example.org
IN PARTICULAR ARTICLE 7 PROVIDES THAT:
- A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him/her exists, regardless of their being already recorded, and communication of such data in intelligible form.
- A data subject shall have the right to be informed:
a) Of the source of the personal data;
b) Of the purposes and methods of the processing;
c) Of the logic applied to the processing, if the latter is carried out with the help of electronic means;
d) Of the identification data concerning data controller, data processors and the representative designated as per Section 5, paragraph 2;
e) Of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
- A data subject shall have the right to obtain:
a) Updating, correction or, where relevant, the integration of the data;
b) Cancelation, correction or blocking of data that has been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
c) Certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
- A data subject shall have the right to object, in whole or in part:
a) On legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b) To the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
A data subject also has the right to object at any time to the sending of unsolicited messages with automated systems.
